Adapting the Laws and Governance of Biological Diversity to Climate Change: Frameworks for Policymakers and Practitioners

Climate change is quickly undermining the ability of laws and policies governing biodiversity to achieve long-term objectives. These laws generally assume that ecological conditions are static, at least within certain parameters. They may forbid translocation of organisms, provide management or restoration targets that reflect past conditions but not current and likely future conditions, or permit increasingly unsustainable harvest quotas. Utilizing adaptive management principles and techniques, this side event assesses capacities of national legal and regulatory frameworks for climate adaptation, and explores opportunities for strengthening resiliency in biodiversity governance. This project is guided by a coalition of advising partners from institutions in developing countries, including Sociedad Peruana de Derecho Ambiental (Peru); Instituto de Abogados para la Proteccion del Medio Ambiente (Dominican Republic); Greenwatch (Uganda); Development and Environmental Law Center (Madagascar); and Law and Policy of Sustainable Development (Vietnam). The partners will release a semi-final draft of a detailed "toolkit" with options for designing adaptive legal frameworks and a report for policymakers on the need to assess adaptive capacities in governing institutions. We seek external reviewers in preparation for release of final materials at the CBD COP in Nagoya, Japan in October 2010.
