Disclosure requirements in patent applications: A tool to prevent misappropriation or an obstacle to innovation?

The side-event will assess the different arguments that have been made in favour and against requiring patent applicants to disclose the origin of genetic resources and traditional knowledge along with evidence of prior informed consent and benefit-sharing. As a contribution to the ABS negotiations, panelists will be asked to consider the role that the international ABS regime could play in supporting disclosure while addressing the concerns on the practicalities and administrative burden associated with such a system. The event will also look at the state of current research in this area and identify gaps and opportunities for future work.
