Crossroads? The Intersection of Canadian Biotech Cases and International Liability Rules

The Canadian cases of Monsanto v. Schmeiser and Hoffman v. Monsanto are some of the first to address the rights and responsibilities that biotechnology companies have in relation to genetically modified organisms. This side event will include presentations on the facts and findings in the two cases, an analysis of the implications of the courts' rulings, a juxtaposition of intellectual property rights and tort responsibilities, and consideration of how these cases relate to the liability and redress negotiations of the Biosafety Protocol.
