Legal and Practical Issues in Development, Negotiation and Implementation of the ABS Regime

<br>This side-event will focus on the legal mechanisms for the creation and implementation of an ABS regime, that could be functional and effective at all levels (local, national, regional, international.) It is based on the outcomes and information developed in the first year of work under a project implemented by the IUCN Environmental Law Centre, financed by the German Ministry for Economic Cooperation and Development (BMZ). This project has brought together over 30 legal experts from 5 continents, to undertake and document intensive research. Its work has focused on looking beneath the standard assumptions to determine the causes underlying the lack of significant progress in implementing ABS under the CBD. <br><br> It will feature presentations by <br> - Jorge Cabrera (InBio, Costa Rica) on the legislative framework needed for effective ABS, <br> - Nyasha Chishakwe (IUCN - Zimbabwe) on regional coordination of the ABS issue in southern Africa, <br> - Jose Carlos Fernandes-Ugalde (INE - Mexico) speaking on the certificate of origin concept, <br> - Kent Nnadosie (ICIPE, Kenya) on IPR issues and the overlap of ABS, the Cartagena Protocol, the ITPGR and UPOV, and <br> - Tomme Young (IUCN Germany) on some options regarding the tools and mechanisms for the development of and effective global regime on ABS.
