The Nagoya Protocol brought several new concepts and approaches into the international ABS debate: the type of intended utilization will decide about the applicability of the Protocol's rules, the idea of strict separation of user and provider countries is abandonded, all Parties to the Protocol are obliged to ensure that genetic resources utilized in their countries have been accessed with a PIC and more. But the Protocol to a large extent lacks substantive provisions on mechanisms and procedures for national implementation of these new concepts. EED, TWN, and EvB will present their analysis of this paradigm shift and suggest approaches to build effective national ABS systems. Also, recent cases of biopiracy will be presented to underline the urgent need for effective national implementation of the Nagoya Protocol and closing of its loopholes.
